Terms of Service

Last updated: 16 September 2026

Overview

Welcome to The Electric Fireplace.

These Terms of Service apply to your use of www.theelectricfireplace.co.nz and to any purchases made through our website.

Throughout these Terms, the words “we”, “us” and “our” refer to The Electric Fireplace. The terms “you” and “your” refer to any person accessing our website or purchasing products from us.

Our online store is powered by Shopify, which provides the e-commerce platform that enables us to offer our products and services to you.

By accessing our website, placing an order or purchasing a product, you agree to these Terms of Service together with our Privacy Policy, Returns & Refund Policy, Shipping Policy and any other policies referred to on our website.

Nothing in these Terms is intended to exclude, restrict or modify any rights you may have under the Consumer Guarantees Act 1993, Fair Trading Act 1986, or any other rights that cannot legally be excluded under New Zealand law.

1. Online Store Terms

You must be at least 18 years old, or have the permission and supervision of a parent or legal guardian, to make purchases through our website.

You agree to provide accurate, current and complete information when placing an order.

You must not use our website or products for any unlawful or unauthorised purpose.

You must not attempt to interfere with the security, functionality or operation of our website.

2. Our Products

We make reasonable efforts to ensure that product descriptions, specifications, dimensions, photographs, videos, colours and other information displayed on our website are accurate.

However, colours and product appearance may vary slightly depending on your device, screen settings, lighting conditions and photography.

Product images used in lifestyle settings may be provided for presentation or illustration purposes. Customers should always refer to the listed product specifications and dimensions when planning an installation.

We may update product specifications, descriptions or availability from time to time.

We reserve the right to discontinue or replace products without prior notice.

Nothing in this section limits your rights where a product does not match its description, is faulty, unsafe or otherwise fails to meet guarantees required by New Zealand law.

3. Fireplace Installation and Use

Our electric fireplaces must be installed and operated in accordance with the supplied user manual, installation instructions and safety requirements.

Before building a fireplace into a media wall, feature wall or other structure, customers and installers are responsible for checking:

  • Product dimensions

  • Installation dimensions

  • Required ventilation

  • Required clearances

  • Electrical requirements

  • Heater outlet locations

  • Access requirements for servicing or removal

Where electrical work is required, it must be carried out by an appropriately qualified person where required by New Zealand law.

Installation instructions must be followed when positioning televisions, cabinetry, wall panels or other materials around the fireplace.

Damage caused by incorrect installation, unauthorised modification, misuse or failure to follow the supplied instructions may not be covered by our limited product warranty.

This does not affect any statutory rights you may have under New Zealand consumer law.

4. Orders

When you submit an order through our website, you are making an offer to purchase the products in your order.

An order is not considered accepted until payment has been successfully processed and we have confirmed the order.

We reserve the right to refuse or cancel an order where reasonably necessary, including where:

  • A product is unavailable

  • Incorrect pricing has been displayed

  • Product information contains a significant error

  • Payment cannot be processed

  • We reasonably suspect fraudulent activity

  • We are unable to supply the product

If we cancel an order after payment has been received, we will refund the amount paid for the cancelled product.

Please carefully review your order, product model, quantity and delivery information before completing checkout.

If you need to change or cancel an order, contact us as soon as possible at support@theelectricfireplace.co.nz. We cannot guarantee that an order can be changed or cancelled after processing or dispatch has begun.

5. Pricing and Payment

Unless stated otherwise, all prices displayed on our website are in New Zealand Dollars (NZD).

GST will be included where applicable.

Shipping or delivery charges may be additional and will be displayed during checkout or otherwise communicated before completion of your purchase.

Prices may change without notice. A price change will not affect an order that has already been accepted, except where there has been an obvious pricing error.

From time to time we may offer promotional pricing, discount codes or special offers. Additional conditions may apply to these promotions.

You agree to provide accurate and authorised payment information when completing a purchase.

6. Shipping and Delivery

We offer shipping to eligible locations throughout New Zealand.

Shipping costs and available delivery options may depend on the product, order size and delivery location.

Any estimated delivery timeframe provided on our website or during checkout is an estimate unless we expressly agree to a specific delivery date.

We will take reasonable steps to ensure products are dispatched and delivered within the agreed or otherwise reasonable timeframe.

If your order is significantly delayed, lost or damaged during transport, please contact us at:

support@theelectricfireplace.co.nz

Please inspect your fireplace and packaging as soon as reasonably possible after delivery.

If you notice transport damage, please keep the original packaging and send us photographs of the product and packaging together with your order details.

Nothing in this section limits our responsibilities for delivery under the Consumer Guarantees Act or other applicable New Zealand law.

7. Pickup Orders

Where pickup is offered, customers may collect their order from our nominated pickup location after receiving confirmation that the order is ready.

Please do not arrive for collection before receiving pickup confirmation.

You may be asked to provide your order confirmation and identification when collecting an order.

Responsibility for the product passes to you once the product has been collected, subject to any rights available under New Zealand law.

8. Returns and Refunds

Returns, exchanges and refunds are handled in accordance with our Returns & Refund Policy available on our website.

Change-of-mind returns may be subject to eligibility requirements including the product remaining unused, uninstalled, undamaged and in its original packaging.

Different rules apply where a product is faulty, defective, incorrectly supplied, damaged in delivery or does not meet the guarantees required by New Zealand consumer law.

Nothing in our Returns & Refund Policy or these Terms limits any rights available to consumers under the Consumer Guarantees Act.

9. Warranty

Our electric fireplaces are supplied with a 12-month limited warranty from the original date of purchase.

Eligible failures caused by defects in materials or workmanship may be repaired or replaced during the warranty period.

The limited warranty does not cover damage caused by:

  • Unauthorised disassembly or modification

  • Incorrect installation

  • Accidental impact

  • Liquid damage

  • Misuse or abuse

  • Failure to follow operating or installation instructions

  • Normal wear and tear

  • Events outside our reasonable control

Proof of purchase may be required for a warranty claim.

For warranty assistance, contact:

support@theelectricfireplace.co.nz

Our 12-month warranty is an additional manufacturer or retailer warranty and does not replace or limit any rights you may have under the Consumer Guarantees Act 1993.

10. Consumer Guarantees

If you are purchasing our products as a consumer in New Zealand, you may have rights under the Consumer Guarantees Act 1993.

These rights may include guarantees that products are:

  • Of acceptable quality

  • Safe

  • Durable

  • Fit for their intended purpose

  • Consistent with their description

  • Consistent with any representations made about them

Where applicable, remedies may include repair, replacement, refund or other remedies available under the Consumer Guarantees Act.

Nothing in these Terms attempts to exclude rights that cannot legally be excluded.

If products are purchased for business purposes, different rules may apply. Any contracting out of the Consumer Guarantees Act will only apply where legally permitted and expressly agreed in writing.

11. Website Information

We make reasonable efforts to keep information on our website accurate and current.

Occasionally our website may contain typographical errors, incorrect pricing, inaccurate specifications, incorrect availability information or other errors.

We reserve the right to correct such errors and update information where reasonably necessary.

If an error materially affects an order you have already placed, we will contact you and provide an appropriate solution.

12. Intellectual Property

Unless otherwise stated, content available through our website—including our branding, logos, product names, photographs, videos, graphics, website design, written content and other materials—is owned by or licensed to The Electric Fireplace.

You may access our website for personal and non-commercial use.

Third-party names, trademarks and intellectual property remain the property of their respective owners.

13. Third-Party Services and Links

Our website may include links to third-party websites, payment providers, applications or other external services.

These services are operated independently from The Electric Fireplace.

We are not responsible for the content, privacy practices or services offered by third-party websites.

Before using a third-party service, you should review its applicable terms and policies.

14. Shopify

The Electric Fireplace is powered by Shopify, which enables us to provide our online store and associated Services.

However, all purchases made through our store are made directly between you and The Electric Fireplace.

Shopify is not the seller of our electric fireplaces and is not responsible for fulfilling your order, providing product support, handling warranty claims or providing remedies relating to products purchased from us.

Your use of certain Shopify features may also be subject to Shopify's applicable terms and privacy policies.

15. Privacy

Personal information collected through our website is handled in accordance with our Privacy Policy and applicable New Zealand privacy law.

Information may be processed by Shopify and other service providers that help us operate our website, process payments, fulfil orders, provide customer support and deliver our services.

Please review our Privacy Policy for further information about how personal information is collected, used, stored and disclosed.

16. Customer Reviews, Photos and Feedback

If you voluntarily submit a product review, photograph, video, testimonial, suggestion or other feedback to us, you confirm that you have the right to provide that content.

Unless otherwise agreed, you grant us permission to use submitted reviews and feedback in connection with operating and promoting our business.

Where photographs, videos or other content identify an individual, we will handle that personal information in accordance with applicable privacy law.

You must not submit content that is unlawful, defamatory, misleading, offensive, infringing or otherwise violates the rights of another person.

17. Prohibited Uses

You may not use our website:

  • For unlawful purposes

  • To commit fraud

  • To provide false or misleading information

  • To infringe intellectual property rights

  • To transmit malware, viruses or harmful code

  • To interfere with website security

  • To collect information about other users without authority

  • To impersonate another person

  • To attempt unauthorised access to our systems

  • To scrape, copy or systematically extract website content without permission where such activity is prohibited by law

We may suspend or restrict access to our website where we reasonably believe these Terms have been breached.

18. Disclaimer and Limitation of Liability

Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy available under the Consumer Guarantees Act, Fair Trading Act or any other law where such rights cannot legally be excluded.

To the maximum extent permitted by law, we are not responsible for indirect or consequential losses that do not arise naturally from our breach or that we could not reasonably have anticipated.

We are not responsible for losses caused by:

  • Use of a fireplace contrary to its instructions

  • Incorrect or unsafe installation

  • Unauthorised modification

  • Damage caused after delivery by the customer or another person

  • Circumstances outside our reasonable control

Any limitation of liability in these Terms applies only to the extent permitted by New Zealand law.

19. Events Outside Our Reasonable Control

We will not be responsible for delays or failure to perform obligations where caused by circumstances reasonably outside our control, such as natural disasters, severe weather, major transport disruption, strikes, government restrictions or significant supply-chain interruptions.

Where such an event affects an existing customer order, we will take reasonable steps to communicate with the customer and provide an appropriate solution.

Nothing in this section limits rights that cannot legally be excluded.

20. Severability

If any provision of these Terms is determined to be unlawful, invalid or unenforceable, that provision will be interpreted or removed to the minimum extent necessary.

The remaining provisions will continue to apply.

21. Entire Agreement

These Terms, together with our policies referred to in them, constitute the agreement governing your use of our website and purchases from us.

If there is a conflict between these Terms and a specific written agreement we have entered into with you, the specific written agreement will apply to the extent of the conflict.

22. No Waiver

If we do not immediately enforce a right under these Terms, this does not mean we have waived that right.

23. Changes to These Terms

We may update these Terms from time to time to reflect changes to our products, services, website, business practices or applicable law.

The latest version will be available on www.theelectricfireplace.co.nz.

Changes will take effect from the date they are published or another date stated in the updated Terms.

Changes will not retrospectively remove rights that have already arisen in relation to an accepted order.

24. Governing Law

These Terms are governed by the laws of New Zealand.

You and The Electric Fireplace submit to the jurisdiction of the New Zealand courts and tribunals, subject to any rights you may have under applicable consumer law.
